Terms of Service
Last updated: October 15, 2026 · Draft for operator and legal review
1. Provider and scope
SayCover is provided by VATINIUS LLC, 8206 Louisiana Blvd NE, STE A #10139, Albuquerque, NM 87113, United States. The Legal Notice identifies the operator and outstanding corporate/contact information. These terms concern the recording, transcription, AI, learning, sharing and export service. Mandatory consumer and privacy rights take precedence over conflicting provisions.
2. Accounts and authority
When you first open the workspace, you accept these Terms by ticking a checkbox. Acceptance, time and document version are recorded. The Privacy Policy and withdrawal information are provided for your information; they are not part of a consent you must give.
Provide accurate account information, protect your credentials and do not use another person’s account without authorization. Only enter a paid contract if you have legal capacity or the required authorization. Organizational users must be authorized to bind their organization. Report suspected account misuse to the operator using the contact information in the Legal Notice.
3. Recording and uploaded materials
Before recording or uploading a recording, obtain all permissions required from speakers, rights holders and, where relevant, the university, employer or meeting organizer. Inform participants about recording, cloud transcription, AI processing and intended sharing before starting. Permission to attend a lecture or meeting is not automatically permission to record it. In Germany, unauthorized recording of non-public spoken words may be an offence under § 201 StGB. A microphone permission prompt is not participant consent.
Only upload or share slides, copyrighted teaching materials and personal data when authorized. Do not submit unlawfully obtained content, authentication secrets, illegal material or sensitive third-party information without an appropriate legal basis and safeguards. Do not use SayCover for covert surveillance, impersonation, harassment, fraud or unlawful automated decisions. See the Privacy Policy.
4. Ownership and processing permission
You retain your rights in your content. You authorize only the processing, storage, transformation and disclosure necessary to provide features you request, including connected services you authorize. This is not a transfer of ownership or a license to publish your content. Your content is not used to train AI models unless you separately and voluntarily opt in under Settings → Privacy; refusing or withdrawing that consent has no effect on your access to SayCover (Art. 7(4) GDPR). See Section 9 of the Privacy Policy. Third-party rights remain unaffected. Share only with intended recipients; recipients or external services may retain their own copies.
5. AI limitations
Transcripts, summaries, notes, answers, flashcards and quiz scores can contain errors, omissions or fabricated details. Review outputs against the source before relying on them. SayCover is not legal, medical, financial or other professional advice, and does not guarantee exam results or factual completeness. Do not use outputs as the sole basis for decisions affecting another person’s rights.
6. Plans, payment and trials
All plans include the same features; the distinction is monthly recording time. Current displayed plans are Free €0, Starter €4.99/month, Pro €9.99/month and Max €19.99/month. The currently configured allowances are 60, 600, 1,800 and 6,000 recording minutes respectively. The operator still needs to confirm those allowances before commercial launch. Check the plan page and final checkout for the binding offer, allowance, applicable taxes and total price. The operator must resolve its tax obligations and correct price disclosure before accepting consumer payments; absence of configured checkout tax is not an exemption.
Eligible new subscribers receive a seven-day trial as shown at checkout. A trial is not offered for every repeat subscription. Where checkout clearly states automatic conversion, the subscription becomes paid at the stated price after the trial unless canceled beforehand. Paid subscriptions renew monthly until canceled. Stripe handles payment details. A payment is due only under the offer accepted at checkout. There is no promise of unlimited recording or rollover of unused minutes.
7. Cancellation, withdrawal and refunds
Subscription management is available through the signed-in Abo page and Stripe customer portal. Cancellation normally prevents future renewal while preserving access through the current entitlement period. Cancellation and statutory withdrawal are different; see Withdrawal information. Mandatory remedies for defective services, overcharges and lawful withdrawal remain available; no blanket “no refunds” rule applies.
Launch requirement: The current customer portal is not certification of compliance with German statutory cancellation and electronic withdrawal-function requirements. Required publicly accessible cancellation/confirmation and withdrawal functions must be implemented and tested before the relevant consumer offer goes live.
8. Local storage, exports and integrations
Export important work. Browser-local lectures and preferences are separate per browser/domain and may be lost when browser data is cleared. Uploaded recording audio and processing jobs also exist server-side. Clearing local data does not cancel a subscription, close an account or delete server-side/Notion/recipient copies. Notion transfers require your authorization and are also subject to Notion’s terms. We do not guarantee uninterrupted availability, but this does not remove statutory obligations concerning service quality, conformity or remedies.
9. Misuse and restrictions
Where necessary and lawful, access or shared content may be restricted to address serious misuse, security incidents, infringement or valid legal requests. Measures should be proportionate and accompanied by notice and an opportunity to respond where practicable and legally permitted. Restrictions do not remove mandatory refund or consumer rights. Send reports identifying the content and reason to the operator.
10. Liability and mandatory rights
Nothing excludes liability where exclusion is prohibited, including applicable liability for intent, gross negligence, injury to life, body or health, fraud or mandatory statutory duties. Other liability is determined by applicable law; these draft terms do not impose a blanket liability waiver. Consumer protections of your country of habitual residence remain applicable where required. These terms do not impose exclusive US courts or waive mandatory European rights.
11. Changes and contact
Material changes require appropriate advance notice and any consent required by law. Changes must not retroactively remove accrued rights or authorize new optional data uses. Legal, billing and support inquiries can be sent to the operator’s postal address in the Legal Notice; a monitored electronic contact still needs to be supplied.
